TrustCare does not directly provide medical, clinical, hospital, surgical, dental, psychological, or healthcare services.

TrustCare's role is strictly limited to facilitating information, commercial guidance, administrative management, user-to-provider connections, appointment coordination, service promotion, and digital communication tools.

2.USER ACCEPTANCE AND RESPONSIBILITY

By using the Platform, the user represents and warrants that:

The user is solely responsible for verifying the qualifications, certifications, licenses, experience, background, and other relevant information of any professional or institution contacted through TrustCare.

  • They have the legal capacity to enter into agreements.
  • The information provided is accurate, current, and complete.
  • They understand that any medical decision or treatment must be evaluated directly with the corresponding professional.
  • They use the Platform at their own risk and responsibility.
  • They accept the inherent risks associated with any medical, aesthetic, surgical, or therapeutic procedure.

3.LIMITATION AND EXCLUSION OF LIABILITY

TrustCare shall not be held liable, directly or indirectly, for:

TrustCare does not guarantee specific outcomes and assumes no obligation regarding the results of procedures, treatments, or services offered by third parties.

  • Professional negligence.
  • Medical complications.
  • Infections.
  • Adverse reactions.
  • Temporary or permanent injuries.

  • Physical, emotional, financial, or moral damages.

5.RELATIONSHIP WITH PROFESSIONALS AND THIRD PARTIES

Professionals, specialists, clinics, providers, and third parties listed or connected through the Platform act independently and under their sole responsibility.

TrustCare does not control, supervise, or direct any medical, clinical, administrative, or commercial activities carried out by such third parties.

Each professional or institution is solely responsible for:

  • Licenses and permits.
  • Regulatory compliance.
  • Medical records.
  • Informed consents.
  • Billing.
  • Medical care.
  • Treatment outcomes.

6.PLATFORM AVAILABILITY

TrustCare does not guarantee that the Platform will operate uninterrupted, securely, error-free, or free from viruses.

The Platform may be modified, suspended, or discontinued, in whole or in part, at any time without prior notice.

TrustCare shall not be liable for losses resulting from technological interruptions, maintenance, system errors, or external failures.

7.ACCOUNTS AND SECURITY

Unauthorized reproduction, distribution, modification, or use is strictly prohibited.

10.PERSONAL DATA AND PRIVACY

The user authorizes TrustCare to collect, store, use, share, and process personal data necessary for operating the Platform and providing related services.

The user acknowledges and accepts that internet transmissions are never completely secure and that TrustCare cannot guarantee absolute protection against unauthorized access, cyberattacks, or external security breaches.

11.INDEMNIFICATION

The user agrees to defend, indemnify, and hold harmless TrustCare, its directors, employees, affiliates, partners, representatives, and providers from and against any claim, lawsuit, legal proceeding, damage, loss, cost, or expense arising from:

  • Relationships with third parties.
  • Medical or aesthetic procedures.
  • Violation of these Terms and Conditions.
  • False information provided by the user.
  • Illegal or negligent conduct by the user.

12.MODIFICATIONS

TrustCare reserves the right to modify these Terms and Conditions at any time.

Any modifications shall become effective upon publication on the Platform.

Continued use of the services constitutes acceptance of the updated Terms and Conditions.

13.GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Colombia.

Any dispute arising from the use of the Platform shall be resolved by the competent authorities of TrustCare's principal place of business.

14.FINAL ACCEPTANCE

By using the Platform, the user acknowledges that they have read, understood, and fully accepted these Terms and Conditions and recognizes that they use the services at their own risk and responsibility.
